1. Definitions and Interpretation

1.1 Definitions

In these Terms and Conditions, unless the context otherwise requires:

• "phopin," "we," "us," "our" refers to phopin Corporation, a Philippine-registered online gaming operator licensed by the Philippine Amusement and Gaming Corporation (PAGCOR) under License No. 2020-PH-089-OL.
• "User," "you," "your," "Member" refers to any individual who registers for and uses the phopin platform and services.
• "Account" means the personal account created by a User upon successful registration on the phopin platform.
• "Services" means all online gambling, gaming, betting, and related services provided by phopin through the website https://phopin.cam and associated mobile applications.
• "Platform" means the website, mobile applications, and all related technologies operated by phopin to deliver the Services.
• "Wager" or "Bet" means any stake placed by a User on a game, sporting event, or other gambling activity offered on the Platform.
• "Funds" or "Account Balance" means the monetary value held in a User's Account, including deposits, winnings, bonuses, and promotional credits.
• "PAGCOR" means the Philippine Amusement and Gaming Corporation, the regulatory authority that licenses and supervises phopin's operations.
• "Terms," "Agreement" refers to these Terms and Conditions, including all policies incorporated by reference.

1.2 Interpretation

References to singular include plural and vice versa. Headings are for convenience only and do not affect interpretation. References to "include" or "including" are not limiting. These Terms are written in English; translated versions are provided for convenience but the English version governs in case of conflict.

2. Acceptance of Terms

2.1 Agreement to Terms

By registering an Account, accessing the Platform, or using any of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. If you do not agree to these Terms, you must not register, access, or use the Platform or Services.

2.2 Capacity and Authority

You represent and warrant that: (a) you are at least 21 years of age; (b) you have full legal capacity to enter into this binding agreement; (c) you are not prohibited from using the Services under Philippine law or the laws of your jurisdiction; (d) all information you provide during registration and thereafter is true, accurate, current, and complete; and (e) you will maintain and update such information to keep it accurate and current.

2.3 Amendments

phopin reserves the right to modify, amend, or update these Terms at any time without prior notice. Changes become effective immediately upon posting to the Platform. Continued use of the Services after changes are posted constitutes acceptance of the modified Terms. You are responsible for regularly reviewing these Terms. Material changes will be communicated via email or Platform notification where feasible.

2.4 Additional Terms

Certain Services or features may be subject to additional terms and conditions, which will be presented to you at the time of use. Such additional terms are incorporated into these Terms by reference.

3. Eligibility and Registration

3.1 Age Requirement

You must be at least 21 years of age to register an Account or use the Services. phopin strictly prohibits minors from accessing or using the Platform. By registering, you represent that you meet this age requirement. phopin reserves the right to request proof of age at any time, including government-issued identification. Failure to provide satisfactory proof of age within a reasonable timeframe will result in Account suspension or termination.

3.2 Geographic Restrictions

The Services are intended solely for residents of the Republic of the Philippines. Users must be physically located within the Philippines when accessing the Platform and placing Wagers. Use of VPNs, proxies, or other methods to circumvent geographic restrictions is strictly prohibited and will result in Account termination and forfeiture of all Funds.

3.3 Registration Requirements

To register an Account, you must: (a) provide accurate personal information including full legal name, date of birth, address, email, and mobile number; (b) create a unique username and secure password; (c) verify your email address and mobile number; (d) agree to these Terms and our Privacy Policy; and (e) complete any additional verification steps as requested.

3.4 Account Limitations

Each User is permitted one (1) Account only. Creating multiple Accounts is strictly prohibited. If duplicate Accounts are detected, phopin reserves the right to close all such Accounts, void all Wagers, and forfeit all Funds including deposits and winnings. Accounts are non-transferable and may only be used by the registered User.

3.5 Account Verification

phopin reserves the right to request verification documents at any time, including but not limited to government-issued photo identification, proof of address, and proof of payment method ownership. Verification is mandatory before processing withdrawals. Failure to provide requested documents within 30 days may result in Account suspension and withdrawal restrictions. All documents must be in English or Tagalog, or accompanied by certified translations.

3.6 Prohibited Users

The following categories of persons are prohibited from registering or using the Services: (a) individuals under 21 years of age; (b) individuals who have self-excluded or been excluded by phopin or any PAGCOR-licensed operator; (c) employees, directors, contractors, or agents of phopin or its affiliates; (d) individuals residing outside the Philippines; (e) individuals subject to bankruptcy proceedings; and (f) individuals with outstanding debts to phopin or related entities.

4. Account Security and Responsibility

4.1 Account Credentials

You are solely responsible for maintaining the confidentiality of your Account username, password, and any other security credentials. You agree to: (a) keep your login credentials secure and not share them with any third party; (b) immediately notify phopin of any unauthorized use of your Account or security breach; (c) log out of your Account after each session, particularly when using shared or public devices; and (d) use a strong, unique password not used for other online accounts.

4.2 Unauthorized Use

phopin is not liable for any loss or damage arising from unauthorized use of your Account, whether or not such unauthorized use was known to you. You remain liable for all activity conducted through your Account until you notify phopin of a security compromise and change your credentials. phopin reserves the right to suspend or terminate any Account where security has been compromised.

4.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to promptly update such information as necessary. Providing false or misleading information is grounds for immediate Account termination and forfeiture of all Funds. phopin reserves the right to verify information at any time and request supporting documentation.

5. Deposits, Withdrawals, and Financial Terms

5.1 Deposits

You may deposit Funds into your Account using payment methods approved by phopin, including GCash, Maya (PayMaya), bank transfer (BPI, BDO, UnionBank), 7-Eleven cash-in, and USDT (TRC20). Minimum deposit amounts are specified at the time of transaction, typically ₱100. Deposits are credited to your Account immediately upon receipt, except bank transfers which may take up to 24 hours. phopin does not charge deposit fees; however, third-party payment processors may impose their own fees.

5.2 Withdrawals

Withdrawal requests are processed after successful Account verification. Minimum withdrawal is ₱200; maximum daily withdrawal is ₱500,000 unless otherwise approved. GCash and Maya withdrawals are typically processed within 15 minutes during business hours; bank transfers within 24 hours. Withdrawal methods must match deposit methods where possible to comply with anti-money laundering regulations. First-time withdrawals require identity verification. phopin reserves the right to decline withdrawal requests if Terms have been violated or fraud is suspected.

5.3 Fees

phopin does not charge withdrawal fees for amounts over ₱500. Withdrawals under ₱500 incur a ₱30 processing fee. Third-party payment processors may charge their own fees. Currency conversion fees apply to transactions involving non-PHP currencies. phopin reserves the right to modify fee structures with 30 days' notice.

5.4 Verification Requirements

All withdrawal requests require successful Account verification, including submission of government-issued photo ID and proof of address. Additional verification may be required for large withdrawals, typically those exceeding ₱50,000. phopin reserves the right to request source of funds documentation for unusually large or frequent deposits.

5.5 Declined or Reversed Transactions

If a deposit is declined, reversed, or charged back by your payment provider, phopin reserves the right to immediately suspend your Account and pursue collection of owed amounts plus administrative fees. Chargebacks initiated in bad faith may result in Account termination and legal action.

5.6 Dormant Accounts

Accounts with no login activity for 12 consecutive months are considered dormant. Dormant accounts with balances under ₱100 may be charged a monthly maintenance fee of ₱50. Accounts dormant for 24 months with positive balances will be contacted via email and SMS. If no response is received within 90 days, remaining Funds may be forfeited in accordance with PAGCOR regulations.

6. Bonuses, Promotions, and Rewards

6.1 Promotional Terms

All bonuses, promotions, and rewards are subject to specific terms and conditions presented at the time of offer. Bonus funds are not withdrawable until wagering requirements are met. Typical wagering requirements range from 10x to 40x the bonus amount, depending on the promotion. Failure to meet wagering requirements within the specified timeframe results in forfeiture of bonus and associated winnings.

6.2 Eligibility and Restrictions

Unless otherwise stated, bonuses are limited to one per User, per household, per IP address, and per device. phopin reserves the right to withhold or forfeit bonuses if Terms are violated, multiple Accounts are detected, or bonus abuse is suspected. Employees and affiliates of phopin are not eligible for bonuses.

6.3 Modification and Cancellation

phopin reserves the right to modify, suspend, or cancel any promotion at any time without prior notice. In the event of cancellation, active bonuses will be honored for Users who qualified before the cancellation.

7. Responsible Gaming and Player Protection

7.1 Age Verification

phopin is committed to preventing underage gambling. All Users must be 21 years or older. Age verification checks are performed during registration and withdrawal processing. If a User is discovered to be underage, the Account will be immediately closed and all Funds forfeited.

7.3 Self-Exclusion

Users may self-exclude for 24 hours, 7 days, 30 days, or permanently through Account settings or by contacting customer support. During self-exclusion, you will be unable to log in, deposit, or wager. Self-exclusion cannot be reversed during the exclusion period. Permanent self-exclusion is irreversible.

8. Prohibited Activities and Account Termination

8.1 Prohibited Conduct

Users are prohibited from: (a) using the Platform for any unlawful purpose; (b) engaging in fraudulent activity; (c) manipulating games or exploiting software vulnerabilities; (d) using bots, scripts, or automated systems; (e) colluding with other Users; (f) providing false information; (g) creating multiple Accounts; (h) money laundering or other financial crimes; (i) harassing staff or other Users; and (j) violating intellectual property rights.

8.2 Consequences of Violation

Violation of these Terms may result in: (a) immediate Account suspension or termination; (b) forfeiture of all Funds including deposits, winnings, and bonuses; (c) voiding of all Wagers; (d) reporting to PAGCOR and law enforcement; and (e) legal action to recover damages. phopin's decision regarding violations is final.

8.3 Account Closure

phopin reserves the right to close any Account at any time for any reason, including but not limited to Terms violations, inactivity, or business reasons. Upon closure, remaining Funds will be returned to the User via their registered payment method, minus any owed amounts or penalties. phopin is not obligated to provide reasons for Account closure beyond Terms violations.

9. Intellectual Property

9.1 Ownership

All content, software, graphics, logos, trademarks, and other intellectual property on the Platform are owned by or licensed to phopin. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes only.

9.2 Restrictions

You may not: (a) reproduce, distribute, modify, or create derivative works of Platform content; (b) reverse engineer or decompile Platform software; (c) remove copyright or proprietary notices; (d) use phopin trademarks without written permission; or (e) frame or mirror Platform content on other websites.

10. Limitation of Liability and Indemnification

10.1 Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. phopin does not warrant that the Platform will be uninterrupted, error-free, or secure. You use the Services at your own risk.

10.2 Limitation of Liability

To the maximum extent permitted by law, phopin shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services. phopin's total liability to you for any claim shall not exceed the amount of Funds in your Account at the time of the claim, or ₱10,000, whichever is less.

10.3 Indemnification

You agree to indemnify, defend, and hold harmless phopin, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your violation of these Terms; (b) your use of the Services; (c) your violation of any law or third-party rights; or (d) any content you submit to the Platform.

11. Disputes and Governing Law

11.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Metro Manila, Philippines.

11.2 Dispute Resolution

Before initiating legal proceedings, parties agree to attempt resolution through good-faith negotiation. If resolution cannot be reached within 30 days, either party may pursue arbitration or litigation. PAGCOR complaints procedures are available for regulatory disputes.

11.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions, class arbitrations, or representative proceedings.

12. General Provisions

12.1 Entire Agreement

These Terms, together with the Privacy Policy and any additional terms incorporated by reference, constitute the entire agreement between you and phopin regarding use of the Services.

12.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12.3 Waiver

Failure by phopin to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

12.4 Assignment

You may not assign or transfer these Terms or your Account without phopin's prior written consent. phopin may assign these Terms to any affiliate or successor without notice.
